Changes to the Swiss Data Protection Act (nFADP) came into effect on September 1, 2023. Here's what this means for you and your customers.
Data Processing Principles
The data processing that has been authorized so far remains permissible under the new legislation. Personal data can only be processed in a lawful manner and must be processed in good faith. It is crucial that data is only processed for the purpose for which it was collected, and that this purpose is clearly identifiable to the individual concerned (processing limitation).
Rights of Individuals - Your Customers
Individuals whose personal data is being processed have the right to obtain information about their own data. This information should normally be provided within 30 days and free of charge for the individuals concerned. Individuals also have the right to have inaccurate data about them corrected or to request its deletion.

Deletion of Personal Data
Personal data must be deleted or anonymized if it is no longer necessary for processing. At any time, the individual concerned can request that all their data held by you be permanently deleted.

Data Security
Access to personal data must be restricted to those who genuinely need it, such as employees or association members, in the course of their professional responsibilities. This must be ensured through appropriate technical and organizational measures. It is also essential to keep websites and computer systems up to date to prevent security vulnerabilities that could have serious consequences.
